A man in his 40s who called celebrity Suzy (real name Bae Suzy) a "national hotel girl" has been convicted.
The Supreme Court's Third Division (Chief Justice Ahn Cheol-sang, presiding) affirmed the original verdict of a fine of 500,000 won in the retrial of Mr. Lee's aunt, who was sent to trial for insulting Suzy on the Internet using expressions such as "national hotel girl.
In October 2015, Lee posted a comment on the news comment section of an internet portal site, "A bubble created by Unple. Just a Kookmin hotel girl," and in December, she was charged with insulting by posting a comment that read, "Why do you attach a movie bomb resin to A (another celebrity)? JYP Unple (media play) Jinghane.
The first trial court found Mr. Lee guilty and fined him 1 million won, but the trial court overturned the decision and acquitted him.
"The 'bubble created by Unple' cannot be seen as more than it is, as it is the result of media play on the victim's popularity or positive articles," the trial court said, "The phrase 'Kookmin Hotel Girl' is a sarcastic reference to the entertainment industry's use of the promotional phrase 'Kookmin Sister,' and the phrase 'movie bombing' is merely a harsh expression of the failure of a movie starring the victim to open at the box office."
As for the phrase 'fading away', the court ruled that it was "a rather harsh expression of the idea that 'the victim's best days are behind her,' given the nature of the entertainment industry, where there are ebbs and flows in popularity and peaks and valleys."
However, in December of last year, the Supreme Court remanded the case, stating that the insult charge was upheld. The court pointed out that "'Kookmin Hotel Girl' sexually objectified the victim by revealing the victim's private life and implying the opposite of the innocent image that the victim appealed to," and that "it can be evaluated as an insulting expression that can lower social evaluation, and it is difficult to see it as a legitimate act as it is outside the scope of legitimate criticism."
After hearing the case again, the trial court found him guilty of the 'Kookmin Hotel Girl' part and sentenced him to a fine of 500,000 won. It acquitted the other expressions.
On this day, the Supreme Court accepted the trial court's decision. The court said, "There was no error in the trial court's judgment, which violated the laws of logic and experience, exceeded the limits of liberal psychology, or misunderstood the law on the establishment of the offense of insult."
