防衛義務を放棄したスティーブン・ユ、韓国の地で終わる

歌手のユ・スンジュン(米国名スティーブ・スンジュン・ユ)に韓国入国ビザを発給しないよう命じる判決が下された。


月13日、ソウル高等法院行政9-3部(チョ・チャンヨン部長判事、キム・ムシン部長判事、キム・スンジュ部長判事)は、在ロサンゼルス(LA)韓国総領事館を相手取り、パスポートとビザの発給拒否を取り消すよう求めた訴訟で、一審判決を覆し、原告勝訴の判決を下した。



これは、外国籍のユ氏がビザを拒否された後、在ロサンゼルス大韓民国総領事館を相手取って起こした2度目の訴えである。



以前、ユ氏は兵役を避けるために米国籍を取得した後、2002年に韓国への入国を禁止された。当時政府は、ユ氏の兵役忌避は安全保障と秩序の維持、対外関係など大韓民国の利益を害する可能性があるため、在外韓国人法の適用除外にあたると判断した。


ユ氏は韓国の海外ビザで入国しようとしたが拒否され、2015年に最初の行政訴訟を起こした。


2020年、最高裁は "在ロサンゼルス総領事館は裁量権を行使せず、ユ氏にビザを発給しなかった "とユ氏に有利な判決を下した。


しかし、領事館はビザの発給を拒否し続けた。「当時、政府はユ氏の兵役離脱が大韓民国の安全、秩序、外交関係など、在外韓国人法に規定された大韓民国の利益を害する可能性が高いと考えた」と領事館は述べている。


ユ氏は2020年10月、この判決は最高裁判決の精神に反するとして2度目の訴訟を起こした。第一審は総領事館と同じ理由でユ氏に不利な判決を下した。


しかし、第二審は同意しなかった。"在外同胞法は2017年に改正されたものであり、それ以前に発生した事象については旧外国同胞法の規定を適用すべきである "と審判所は説明し、旧外国同胞法の第5条2項には "第1号または第2号に該当する外国人が38歳に達したときは、この限りでない "と記載されていることを指摘した。


この規定は2017年に改正され、基準が38歳から41歳に引き上げられたため、総領事館はこれを理由に柳氏のビザ発給を拒否したが、控訴審は申請日である2015年時点の旧外国人法を適用し、「特段の事情がない限り、在留資格を認めるべき」との判断を示した。
